RULES FOR RETURNING FULL-VALUE GOODS IN BRICK-AND-MORTAR STORES
1. These Regulations define the rules for the acceptance and execution by the seller – HEXELINE Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Łódź, at ul. Aleksandra Puszkina 62/64 (92-516 Łódź), entered in the Register of Entrepreneurs of the National Court Register under number 0000533223 – of accepting and processing returns of goods in perfect condition.
2. The content of the Regulations is available free of charge on the seller's website at: www.hexe.com.pl in a form that allows it to be saved and printed. This ensures that the content of the Regulations can be read before concluding a sales contract.
3. The Terms and Conditions set out the rules for returning goods in perfect condition, i.e. goods without physical defects or legal defects within the meaning of the Civil Code.
4. The customer is entitled to return goods in perfect condition only if this right is granted to the customer by the seller. This does not apply to cases where the right to return goods results from generally applicable provisions of law (e.g. online purchase). In such a case, the rules and conditions for exercising the right to return goods are specified by the relevant provisions. Notwithstanding the first sentence of this paragraph, the customer is entitled to return the goods within 7 days of the date of purchase. After this period, the right to return the goods expires.
5. If the return of full-value goods is accepted, the seller shall refund the sale price exclusively in the form of crediting the HEXE card with an amount corresponding to the sale price paid. No refunds in the form of cash, bank transfer or card transfer are provided for. The card is not a payment card within the meaning of the provisions on payment and financial instruments.
6. The customer's exercise of the right to return goods in full condition means acceptance of the above form of refund of the sale price. If this form of refund is not accepted, the seller will refuse to accept the return of goods in full condition.
7. The funds from the return, credited to the gift card, are intended exclusively for the purchase of further goods from the seller's commercial offer (including its online offer) within 12 months from the date of returning the full-value goods. If the customer makes another purchase within the above period, they may pay using the funds accumulated on the card. After 12 months from the date of return of the full-value goods, any unused funds shall be forfeited to the seller.
8. Payment by card is made by presenting the card at the time of payment for the goods. If the price of the goods selected by the customer exceeds the card balance, the customer is obliged to pay the missing part of the price in a manner accepted by the Sales Outlet.
9. If the price of the goods selected by the customer is lower than the balance on the card, the seller is not obliged to refund the remaining balance to the customer, and thus the balance not used by the customer remains available for use at a later date, until the expiry date of the card. The card may be used by the customer without restriction until the amount on it is exhausted, but no later than the expiry date of the card. The customer may check the balance on the card at any Sales Outlet until the expiry date of the card.
10. The Seller has the right to refuse to accept payment by card if the card has expired, if there is reasonable suspicion that the card has been altered in an unauthorised manner or forged, or if the card has been damaged in such a way that the data stored on it, in particular the balance data, cannot be read.
11. The Seller shall make every effort to ensure the uninterrupted operation of the Cards. However, it reserves the right to temporarily suspend the possibility of paying with them or checking the balance in the event of a failure or technical modernisation of the infrastructure necessary to use the cards.
12. All complaints regarding the cards should be submitted in writing at the Sales Outlets, under pain of nullity. The complaint should include a detailed description of the event that is the subject of the complaint, as well as the request and contact details of the person submitting the complaint. The Seller shall consider a correctly submitted complaint within 14 (fourteen) days of receiving the complaint prepared in the manner described above. If additional information is required from the customer in order to properly consider the complaint, the above period shall be counted from the date on which the complaint is supplemented by the person submitting it. The above provisions do not affect the rights of customers who are consumers and are provided for by generally applicable laws.
13. The customer may check the balance on the card at any Sales Outlet until the expiry of the period referred to in paragraph 7.
14. The Issuer reserves the right to amend the Terms and Conditions, whereby such amendments shall apply to returns made after the date of entry into force of the amended Terms and Conditions. The amendments referred to above shall take effect within 7 (seven) days of the publication of the new version of the Terms and Conditions.
15. The Regulations shall enter into force on 16 February 2023.
